By contacting Santa Barbara Asphalt Paving, requesting an estimate, or engaging us to perform any work, you agree to these terms and conditions. If you do not agree, please do not request services. Santa Barbara Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, striping, drainage, and related contractor services in Santa Barbara County and surrounding areas. The specific scope of work for each project is defined in a written estimate or work order agreed upon by both parties before work begins. We do not provide services outside the agreed scope without written authorization and a revised estimate.
All estimates are provided in writing and are based on the conditions observed at the time of the site visit. Estimates are valid for 30 days from the date issued unless otherwise noted. Prices may change if:
We will notify you of any price changes before proceeding. You have the right to decline any revised estimate without obligation.
Project start dates are confirmed at the time of contract signing. Scheduling is subject to crew availability and weather conditions. Asphalt work cannot be performed in rain or when pavement temperatures are outside acceptable installation ranges. We will contact you promptly if a scheduled date needs to change due to weather.
If you need to cancel or reschedule a confirmed project, please notify us as soon as possible. Cancellations with less than 48 hours notice for a confirmed start date may result in a fee to cover mobilization costs already incurred. We will discuss any applicable fees with you at the time of cancellation.
Payment terms are specified in your written estimate or contract. For most projects, a deposit is required before work begins, with the balance due upon completion. Accepted payment methods are stated on your invoice.
Invoices not paid within the agreed terms may accrue interest at the maximum rate permitted under California law. If collection efforts are required, the customer agrees to pay reasonable attorney fees and collection costs in addition to the outstanding balance.

Santa Barbara Asphalt Paving is not responsible for damage to underground utilities, irrigation systems, or other buried infrastructure that was not disclosed or marked prior to the start of work.
We stand behind our workmanship. Any warranty terms specific to your project will be stated in writing in your contract. In general:
To the extent permitted by California law, our total liability for any claim arising from services provided shall not exceed the amount paid for those services. We are not liable for indirect, incidental, or consequential damages.
Santa Barbara Asphalt Paving carries general liability insurance and workers' compensation coverage. Our liability for property damage that occurs during the course of a project is limited to direct, documented damage caused by our crew or equipment. We are not responsible for pre-existing conditions, structural issues unrelated to our scope of work, or damage that occurs after project completion due to normal use, weather, or circumstances outside our control.

These terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Santa Barbara County, California.
We may update these terms and conditions from time to time. Changes take effect when posted to this page with a revised effective date. Continuing to request or receive services after an update constitutes acceptance of the revised terms. We recommend reviewing this page periodically.
